Our "fill-in-the-blank" legal form package for establishing legal and physical custody, and if necessary, paternity, will include every document necessary to obtain a court order determining each parent's respective rights. Legal custody refers to decision making, and physical custody refers to where (with whom) and when (schedule) the child/ren will reside. There are basically 3 steps in the process:

Filing a Petition & other required documents;
Serving (or accepting) copies of filed documents;
Finalizing by mutual agreement or trial.

If paternity of the child has already been legally established by the Department of Health and Welfare in order to obtain a child support order against the father, then either parent can file a Petition for Custody and to Modify Child Support. If paternity has not yet been legally established, then you need to file a Petition for Paternity, Custody, Visitation and Support.
